Cabinet Decision No. 33/2013
On the Organisational Structure of the Insurance Authority
The Cabinet,
Having perused the Constitution,
The Federal Law No. 1/1972 on the Law on the Competencies of the Ministries and Powers of the Ministers, and its amending laws:
The Federal Law No. 6/2007 on the establishment of the Insurance Authority and regulation of its operations, and its amending laws,
And according to the approval of the Cabinet,
Decided the following:
Article 1 - Definitions
In the implementation of the provisions of this Decision, the following words and expressions shall have the meanings stated beside them unless the context requires otherwise:
Authority: Insurance Authority.
Board of Directors: Authority's Board of Directors.
Chairman: Chairman of the Authority's Board of Directors.
Director General: Authority's Director General.
Article 2
The organizational structure of the Authority shall be formed according to the organizational chart enclosed to this Decision and as stated in the following Articles.
Article 3 - Board of Directors
The Board of Directors is the supreme authority specialized in the Authority's affairs and the conduct of its operations. It shall, for this purpose, carry out the following:
1-Develop the Authority's general policy and approve the plans and programs necessary for the implementation thereof.
2-Approve the draft laws related to the insurance business and submit them to the Cabinet.
3-Issue the necessary instructions to implement the provisions of this Law and regulations issued pursuant thereto.
4-Approve the Authority's annual budget and submit it to the Cabinet for approval.
5-Approve the Authority's annual report and final accounts and submit them to the Cabinet.
6-Appoint an auditor and determine his fees.
7-Accept aids, donations and grants that are consistent with the objectives of the Authority.
8-Decide on the objections submitted by the company for the amendment of the insurance policies forms and annexes.
9-Any other functions related to the Authority's affairs and objectives.
Article 4 - The Organizational Units of the Board of Directors
The following organizational units shall report to the Board of Directors:
1-Internal Audit Department.
2-Director General.
Article 5 - Internal Audit Department
The Internal Audit Department shall verify the compliance if the Authority's organizational units with the financial and administrative regulations and shall carry out the following:
1-Follow, in auditing works, the principles, norms and standards accepted legally, financially and administratively.
2-Verify the compliance of the departments with the application of all financial and administrative regulations in force at the Authority.
3-Submit a comprehensive report to the Director General on the results of financial and administrative auditing and make appropriate suggestions and recommendations.
4-Any other functions assigned by the Board of Directors.
Article 6 - Director General
The Authority shall have a Director General who shall help the Board of Directors in the management of the Authority and shall exercise the following powers and functions:
1-Implementation of the policy, plans and programs approved by the Board of Directors.
2-Suggest the organizational structure of the Authority and supervise the same in a way ensuring the proper functioning thereof.
3-Prepare programs and plans to develop the insurance sector and raise the level of services to be presented to the Board of Directors.
4-Prepare draft laws, regulations, instructions and decisions issued under the provisions of the Law related to the insurance business and present them to the Board of Directors.
5-Prepare the Authority's draft annual budget and present it to the Board of Directors.
6-Consider the complaints submitted concerning the insurance services and take appropriate decisions in their regard unless they are required to be presented to the Board of Directors.
7-Issue the necessary decisions conferred upon him under the provisions of the Law.
8-Any other functions assigned by the Board of Directors.
Article 7 - The Organizational Units of the Director General
The following organizational units shall report to the Director General:
1-Director General's Office.
2-Institutional Development Office.
3-Training Institute.
4-Strategic Communication Department.
5-Licensing and Registration Office.
6-Control Department.
7-Legal Affairs Department.
8-Support Services Department.
Article 8 - Director General's Office
The Director General's Office aims to provide administrative support services and undertakes the supervision, coordination and regulatory follow-up of all matters submitted to the Director General. It shall, for that purpose:
1-Prepare all meetings and special events related to the Director General.
2-Organize official communication and correspondences with various authorities.
3-Carry out various secretarial works, prepare and print the correspondences and reports of the Director General.
4-Any other functions assigned by the Director General.
Article 9 - Institutional Development Office
The Institutional Development Office shall:
1-Develop a specific methodology to draw strategic and operational plans, lay down the policies, their implementation priorities and their measurement mechanism at the Authority.
2-Prepare and develop the strategic and operational plans and the Authority's action programs, implement their application results in coordination with the concerned departments.
3-Coordinate for the development of the performance development plans at the Authority according to the performance evaluation results.
4-Design the measurement indicators and submit performance reports to all the Authority's organizational units.
5-Apply quality systems and the model requirements of corporate performance development and government excellence at the Authority in a way promoting the culture of excellence and outstanding service to customers.
6-Any other functions assigned by the Director General.
Article 10 - Training Institute
The Training Institute shall:
1-Provide qualified manpower to exercise insurance business.
2-Provide training for employees related to the insurance business.
3-Any other functions assigned by the Director General.
Article 11 - Strategic Communication Department
The Strategic Communication Department shall:
1-Follow the international developments related to the insurance sector, especially concerning the works and activities of the International Association of Insurance Supervisors (IAIS).
2-Conduct political analysis and forecasting of international relations as well as the functions and duties of the international organizations related to insurance.
3-Suggest draft agreements and memoranda of understanding to be concluded with the insurance organizations and authorities in coordination with the Legal Affairs Department.
4-Reply to the correspondences related to international organizations.
5-Prepare for the conferences and meetings sponsored by the Authority.
6-Coordinate both internally and externally on the activities of international and local organizations and the benefit areas thereof.
7-Coordinate to participate in meetings and activities held by the regional, Arab and international insurance organizations in a way to achieve the objectives thereof.
8-Conduct effective communication inside and outside the Authority, develop and implement the media plans and programs related to government communication, carry out various media activities and supervise the same.
9-Disseminate insurance awareness among all society classes and segments through insurance awareness plans and programs and provide media support to the Head of the Authority and the senior staff thereof.
10-Any other functions assigned by the Director General.
Article 12 - Licensing and Registration Office
The Licensing and Registration Office shall:
1-Accept the license applications of the insurance companies and the professions related to the insurance industry and recommend the acceptance or rejection thereof, prepare the license decision upon the consent of the Board of Directors upon the application.
2-Accept the registration applications of the insurance companies and professions related to the insurance sector and study the same and prepare the certificates of registration upon acceptance thereof.
3-Accept the registration renewal applications and the professions related to insurance and prepare registration renewal certificates related to the same.
4-Accept the annotation applications to amend the data in the insurance companies' register and the registers of insurance-related professions.
5-Follow the commitment of the insurance companies and insurance-related professions to renewing the registration on the specified dates and recommend the actions to be taken towards those failing to renew according to the Insurance Law and its implementing regulations.
6-Coordinate with the local economic departments regarding the licensing procedures of the insurance companies and the insurance-related professions.
7-Provide the various parties in the government and private sectors of the statements of insurance sector registered in the Authority's registers.
8-Any other functions assigned by the Director General.
Article 13 - Control Department
The Control Department shall:
1-Monitor the performance of the regional and international re-insurance companies and peruse the reports prepared on the same by the Research and Evaluation Centres, predict the reflection of its performance on the insurance sector at the State and suggest the necessary measures for the same.
2-Check on the annual budget and final accounts of the insurance companies and any financial data required during the year, ensure the financial solvency of the companies and ensure the investment of the company's funds in accordance with sound principles.
3-Prepare statistics related to the technical and financial aspects of the insurance companies and insurance-related professions.
4-Conduct supervision and inspection operations on all insurance companies and insurance-related professions to ensure the application of the provisions of the Insurance Law and the regulations and instructions issued for the same, and make recommendations related to the penalties and fines to be implemented.
5-Any other functions assigned by the Director General.
Article 14 - Legal Affairs Department
The Legal Affairs Department shall:
1-Prepare and update the draft regulations and legislations issued by the Authority and develop the policies and legislations related to the insurance sector.
2-Give legal opinion and respond to legal enquiries and consultations in addition to the statistical insurance issues and exchange technical views with the relevant authorities inside and outside the State.
3-Prepare, implement and follow the decisions issued by the Authority and review all legal memoranda and documents submitted to the judicial authorities in the lawsuits where the Authority is a party, in coordination with the Ministry of Justice.
4-Study and evaluate the new insurance products before offering them for subscription in the insurance market, in coordination with the relevant departments.
5-Develop systems for the protection of the rights of the insured, the beneficiaries and all those working in the insurance field.
6-Develop and organize the means of settling insurance disputes in collaboration with the other Authority's departments.
7-Create databases on the insurance activities in the United Arab Emirates and other countries, collect, compilate and analyse the statistical data on the insurance sector of all fields.
8-Prepare reports, studies, research and legal projects required by the Authority's works and related to the insurance sector and archives to form a reference for researchers.
9-Carry out investigation procedures with the violators, aiming at gathering evidence on any works or practices violating the provisions of regulations and legislations issued by the Authority.
10-Any other functions assigned by the Director General.
Article 15 - Support Services Department
The Support Services Department shall:
1-Provide technical support for the organizational units at light of the Authority's strategy in the IT field.
2-Manage human resources, preserve the best human competencies and develop the same.
3-Prepare the Authority's annual budget, financial statements and final accounts and apply the approved financial policies, regulations and procedures.
4-Complete the procurement process in accordance with the instructions and regulations of the Ministry of Finance.
5-Provide necessary logistical support to the Departments.
6-Any other functions assigned by the Director General.
Final Provisions
Article 16
The approved organizational structure of the Authority shall not be amended at the Departments' level and above except by a Cabinet Decision issued according to the procedures followed in this regard.
Article 17
The President shall issue the decisions necessary for the implementation of the Authority's organizational structure. He may establish, develop or amend the organizational units of the Departments stated in the organizational structure (Section / Division) and determine the competencies thereof according to the procedures followed in this regard.
Article 18
This Decision shall be published in the Official Gazette and shall come into force from the date of issuance thereof.
