Court mandates repayment of misused restaurant funds

The Abu Dhabi Family and Civil Administrative Court has issued a landmark ruling requiring a former restaurant manager to return Dh57,976 embezzled from the establishment's funds. The court also awarded Dh5,000 in compensation for financial damages incurred by the restaurant due to the manager’s actions.
The legal dispute arose after the restaurant’s management filed a lawsuit against the former manager, demanding repayment of Dh57,976 and an additional Dh50,000 as compensation for financial and moral damages.
A forensic accounting report submitted to the court played a pivotal role in substantiating the claims. It revealed that the defendant had used his managerial position and access to the restaurant's bank account to embezzle funds. While the report confirmed that Dh818,424 out of Dh876,345 withdrawn was legitimately spent on restaurant operations, Dh57,976 remained unaccounted for due to a lack of supporting documentation.
1. Breach of Trust and Criminal Liability
The defendant had been criminally convicted for embezzlement and breach of trust, violations under UAE’s Federal Decree Law No. 31 of 2021 (UAE Penal Code). The law criminalizes acts of dishonesty by individuals in positions of trust, holding them accountable for misappropriating funds entrusted to them.
In this case, the defendant’s unauthorized use of funds and failure to provide proper documentation constituted a clear breach of fiduciary duty. The forensic evidence presented was deemed sufficient to establish the defendant’s liability.
2. Civil Liability and Compensation
The court also examined the civil implications of the defendant's actions under UAE Civil Transactions Law (Federal Law No. 5 of 1985). The embezzlement resulted in both material damages (financial losses) and moral damages (distress and reputational harm).
Material Damage: The embezzled amount of Dh57,976 directly impacted the restaurant's financial stability, justifying the court's order for repayment.
Moral Damage: The restaurant argued that the embezzlement caused significant distress and disruption. Although the court acknowledged this claim, it awarded Dh5,000 in compensation, finding the requested Dh50,000 excessive and unsupported by evidence.
The court’s ruling underscores the UAE’s stringent approach to financial crimes and its emphasis on maintaining trust in professional relationships. By holding the defendant both criminally and civilly liable, the court reinforces the principle that individuals in fiduciary roles must adhere to the highest standards of integrity.
This case highlights the importance of corporate accountability, robust internal controls, and legal recourse for financial misconduct. Employers are encouraged to implement stringent monitoring mechanisms to safeguard against similar breaches of trust.
