Court Warns Against Manipulative Tactics in Rental Disputes

In a landmark decision, the Dubai Rental Disputes Center has ruled in favor of a tenant who was unlawfully evicted, ordering the landlord to pay Dh700,000 in compensation. The case highlights the consequences of deceptive eviction practices, as the court found the landlord guilty of manipulating legal procedures to remove the tenant unfairly.

Case Background: Tenant Unjustly Evicted

The dispute arose when a European tenant, who had fully paid the annual rent for 2023-2024 to the original property owner, faced unexpected eviction after the villa was sold to a new landlord. The new property owner falsely claimed the rent had not been paid and initiated legal proceedings for eviction.

To complicate matters, the landlord deliberately provided an incorrect email address for the tenant when filing the case, preventing the tenant from receiving official court notifications. As a result, the tenant was unaware of the legal proceedings and was issued a default judgment, ordering his eviction and alleged rent arrears.

Forced Eviction and Tenant’s Shock

Following the eviction order, the landlord wasted no time enforcing the judgment. The tenant’s locks were changed, personal belongings were removed, and further legal measures—including a request for travel bans and financial restrictions—were pursued.

The tenant, who was away on vacation during these events, returned to find himself locked out of his home, with no prior knowledge of the legal battle against him.

Court Overturns Eviction and Awards Damages

Upon discovering the situation, the tenant sought legal advice and challenged the eviction. A thorough investigation by the Dubai Rental Disputes Center revealed the landlord’s misconduct. The court overturned the eviction order, nullified all enforcement actions, and reinstated the tenant’s rights to the property.

Additionally, the tenant filed for damages, citing financial losses, legal expenses, hotel accommodation costs, and emotional distress. After reviewing the case, the court ruled in his favor, ordering the landlord to pay Dh700,000 in compensation, equivalent to three years’ rent.

Legal Warning: Landlords Must Follow Proper Procedures

Judge Abdul Qader Mousa Mohammed, Chairman of the Dubai Rental Disputes Center, emphasized the center’s commitment to upholding fairness in rental agreements. He warned landlords against engaging in deceptive eviction tactics for financial gain, highlighting that such practices carry severe legal and financial repercussions.

He also advised tenants to maintain proper documentation of rental payments and communicate through official channels to avoid similar disputes. Tenants were urged to take legal action if landlords refuse to accept payments, ensuring their rights are safeguarded.

This case serves as a strong reminder that rental agreements must be honored by both parties, and legal procedures should not be misused for personal gain.
