Abu Dhabi Civil Court Rejects Worker’s Claim Over Withdrawn Job Offer

Dh95,000 compensation bid dismissed after judge rules visa refusal was not the employer’s fault.

The Abu Dhabi Family, Civil and Administrative Cases Court has dismissed a lawsuit filed by an employee who sought Dh95,000 in compensation after accusing a company of issuing a ‘non-serious job offer’.

 

The claimant argued that the firm had breached its obligations after he resigned from his previous role, signed an employment contract and began working, only for the offer to be withdrawn.

 

Court documents show the employee said he received a formal offer following almost a year of interviews and was instructed to leave his earlier job. He signed a contract with a monthly salary of Dh36,500, and an entry visa was issued. But after he started work, the employer allegedly submitted incorrect academic details -- listing him as a diploma holder rather than reflecting his actual qualification -- which led to the visa being rejected twice.

 

The company countered that the job offer was contingent on approval from the relevant authorities, a requirement that was not met for reasons outside its control. Without an approved work permit, it said, the offer had to be withdrawn.

 

The court found that the visa rejection resulted from the decision of the competent authority and not from the company’s actions. It ruled there was no contractual breach, dismissed the lawsuit and ordered the plaintiff to cover court fees and costs.
