
Woman Secures Dh1M Repayment After Decisive Oath Sways Abu Dhabi Court
The Abu Dhabi Civil Family Court rules in claimant’s favour after oath settles dispute over signed trust receipt.
The Abu Dhabi Civil Family Court has ordered a man to return Dh1 million to a woman after she established her claim by taking a decisive oath in a dispute centred on a signed trust receipt.
Court papers show that the woman filed a lawsuit seeking the recovery of Dh1 million, along with associated legal costs, asserting that the defendant had received the funds and signed a trust receipt confirming his obligation to return the amount upon request.
The defendant denied the claim and urged the court to dismiss the case, stating that it lacked legal and factual basis. He further requested that the court require the claimant to take a decisive oath to resolve the matter.
The court asked the woman if she was willing to take the oath, and she confirmed her readiness. She then delivered the oath in the exact wording specified by the court.
In its judgment, the court noted that the decisive oath had been requested by the defendant as a means of settling the dispute on the basis of the claimant’s conscience. Once the court accepted this request and the claimant swore the oath, the dispute was deemed resolved in her favour.
The court subsequently ordered the defendant to repay the full Dh1 million.
