Court Awards Dh140,000 Compensation to Worker Seriously Injured in Crash

Abu Dhabi Cassation Court upholds insurer and company liability for employee left with 25 per cent permanent disability.

The Abu Dhabi Court of Cassation has upheld a ruling directing an insurance company and a firm to jointly pay Dh140,000 in compensation to an employee who suffered serious and permanent injuries in a road accident involving a company vehicle.

 

According to court records, the victim sustained skull fractures and lasting damage to his brain and nose, leaving him with facial scarring and a 25 per cent permanent disability as assessed by medical experts.

 

The accident occurred on December 27, 2024, when the company-owned vehicle collided with the rear of a heavy freight trailer. The crash claimed the driver’s life and left others injured.

 

The claimant had sought Dh650,000, citing loss of income and psychological trauma. However, the insurer argued its liability should be limited to Dh50,000, based on standard policy provisions linked to a percentage of Diyya.

 

The court rejected this argument, pointing to a “Personal Accident” extension in the policy that provided coverage of up to Dh200,000 for passengers. It ruled that Dh140,000 was fair compensation for the physical and emotional harm suffered, dismissing appeals from both parties.
