Pedestrian Hit-and-Run: Abu Dhabi Court Orders Dh30,000 Compensation

Driver fled the scene in breach of traffic and safety laws; court holds motorist and insurer jointly liable.

An Abu Dhabi court has ordered a driver and an insurance company to jointly pay Dh30,000 in compensation to a pedestrian who was knocked down and injured after the motorist fled the scene of the accident.

 

The Abu Dhabi Civil Family Court found that the driver had violated traffic signs, road safety regulations and legal obligations by leaving the scene without any acceptable justification.

 

According to court records, the injured man filed a civil lawsuit against both the driver and the insurer, seeking Dh150,000 in compensation for material and moral damages. He also claimed legal interest of five per cent until full payment, along with court fees, expenses and legal costs.

 

The claimant told the court that the driver struck him with the vehicle, causing multiple injuries. A criminal case was subsequently registered, resulting in a conviction against the motorist.

 

The court heard that the driver’s actions caused physical harm, including bodily injuries, as well as moral damage in the form of psychological suffering. The pedestrian said he experienced fear, anxiety and emotional distress following the hit-and-run incident.

 

In its ruling, the court held the driver fully responsible for the accident, noting that fleeing the scene amounted to a serious legal and ethical violation. While acknowledging the established liability, the court reduced the compensation sought after assessing the extent of the proven damage.

 

The court ultimately ordered the driver and the insurance company to pay Dh30,000 in compensation, holding them jointly liable for the injuries and losses arising from the incident.
