
Abu Dhabi Court Orders Doctor, Hospital to Pay Dh50,000 for Surgical Error
Judges dismiss Dh200,000 damages claim, finding compensation proportionate to patient’s harm.

The Abu Dhabi Civil Family Court has ordered a doctor and a private hospital to jointly compensate a patient with Dh50,000 ($13,600) after a surgical error during a spinal fusion procedure led to corrective surgery.
The patient had sought Dh200,000 in damages plus 12 per cent annual interest, alleging the surgeon failed to meet the required standard of care. Court documents revealed that the doctor implanted an ill-fitted cervical cage, which later necessitated an additional operation.
A report by the Supreme Committee of Medical Liability found the error did not amount to gross negligence but still constituted a breach of proper medical practice. The court accepted the findings, calling the report “technically sound and prepared by specialists.”
Holding both the physician and the hospital -- his employer -- responsible, the court awarded compensation for material and moral damages. However, it rejected the plaintiff’s larger claim of Dh200,000, ruling that Dh50,000 was adequate and proportionate. The defendants were also directed to bear court fees and expenses.
