
Fraudster Ordered to Repay Dh70,000 Seized from Woman, Pay Compensation
Court awards Dh72,500 in total compensation, upholds fraud conviction and rejects claim for interest.
The Abu Dhabi Family, Civil and Administrative Cases Court has ordered a man to repay Dh72,500 to a woman after it was proven he fraudulently seized Dh70,000 from her, along with additional compensation for material and moral damages.
The ruling includes the return of the full stolen amount, Dh2,500 in compensation, and obliges the defendant to pay court fees and expenses. The court also rejected the claimant’s request for legal interest and immediate enforcement of the judgment.
According to case details, the woman had filed a lawsuit seeking Dh80,000 in total, including Dh70,000 allegedly taken from her through fraudulent means and Dh10,000 as compensation for damages suffered. She also requested 12 per cent annual legal interest from the date of filing the case until full repayment.
She stated that the man had unlawfully obtained Dh70,000 from her through fraudulent methods, prompting her to file a police complaint. The matter was subsequently referred to the Public Prosecution, where the accused was convicted and sentenced to one year in prison. The conviction was later upheld on appeal and became final after no further challenge was filed before the Court of Cassation.
In its reasoning, the civil court noted that the final criminal judgment had already established the defendant’s guilt. Based on case records and investigation findings, the court confirmed that the man had unlawfully seized the amount without legal justification and was therefore obligated to return it.
The court also found that the woman had suffered both material and moral damages as a result of the incident, and set compensation at Dh2,500.
However, it dismissed the claim for additional legal interest and declined to include the judgment for immediate enforcement. The defendant was also ordered to bear all fees and expenses.
