Court Orders Firm to Pay Dh193,671 to Employee in Delayed Wages and Benefits

Ruling covers overdue wages, end-of-service gratuity and annual leave compensation for former employee.

An Abu Dhabi Labour Court has ordered a company to pay Dh193,671 to a former employee after finding that it had failed to settle his statutory employment dues following the end of his service.

The employee filed a lawsuit seeking payment of his labour entitlements and related expenses. Court records showed that he had worked for the company for more than 17 years, earning a basic monthly salary of Dh7,000 and a total monthly salary of Dh9,500.

In his claim, the employee sought end-of-service gratuity of Dhs183,750, annual leave compensation of Dh15,000, the cost of a return air ticket and unpaid salaries amounting to Dh60,483 for several months.

The court noted that the case file contained no evidence proving that the company had settled the employee’s outstanding wage claims. It therefore ruled that he was entitled to recover his overdue salaries.

Taking into account his service period of more than 17 years, the court calculated his end-of-service gratuity entitlement at Dh118,188.

Addressing the annual leave claim, the court pointed out that labour law guarantees employees fully paid annual leave of at least 30 days for every year of service. Employees who leave their jobs before using their accrued leave are entitled to compensation for the unused balance, calculated on the basis of their basic salary.

The court further stated that workers are also entitled to payment for leave accrued during part of a year in proportion to the period worked.

Accordingly, the court awarded the employee Dh15,000 for unused annual leave in addition to his other labour entitlements, bringing the total amount payable to Dh193,671.
