The Al Ain Civil, Commercial and Administrative Court has ordered a car garage to pay Dh35,000 in compensation to a vehicle owner after it failed to properly replace the car’s engine and returned the vehicle with several new faults.

The owner had entrusted the garage with a full engine replacement, advertised as a “new, agency-condition engine” and backed by a one-month warranty, at an agreed price of Dh11,500. However, the garage allegedly performed the work to a substandard level, resulting in additional mechanical issues. It also transported the vehicle without the owner’s consent and refused to return it in a roadworthy state, leading to financial losses.

A court-appointed mechanical expert confirmed that the parties had agreed to a clear technical specification for an engine matching agency standards and that the owner had paid the full amount via official bank transfers. The garage was unable to provide any proof of a subsequent agreement modifying the required specifications or execution.

The expert further noted that the defects discovered in the engine and vehicle appeared within the warranty period stated on the invoice.

Relying on the expert report, the court held the garage liable for negligence and breach of contract and ruled that compensation of Dh35,000 was warranted.
