Court Orders Property Owner to Pay Dh332,990 to Contractor After Dispute

Owner’s appeal dismissed as claim falls below Dh500,000 threshold; payment order now final and enforceable.

The Abu Dhabi Court of Cassation has upheld a ruling requiring a property owner to pay over Dh332,990 to a contractor, bringing an end to a protracted payment dispute.

 

In its final judgment issued on August 7, the court dismissed the owner’s appeal against an earlier decision in favour of the contractor. The appeal was rejected on procedural grounds, as the disputed amount fell below the Dh500,000 minimum threshold for cassation appeals under Article 175(1) of Federal Law No. 42 of 2022 on Civil Procedure, making the order immediately enforceable.

 

Dispute and counterclaims
The case stemmed from disagreements over construction works carried out on the owner’s property. Initially, the property owner filed a civil commercial lawsuit, claiming the contractor had failed to complete the agreed work, and was awarded Dh250,000 in compensation.

 

The contractor subsequently filed a separate claim seeking Dh332,990 for works completed, along with 12% annual interest from the date of filing until full settlement. A technical expert’s report concluded that approximately 89% of the contracted work had been completed.

 

Final outcome
The court ordered the property owner to pay:

 

  • Dh332,990 for completed works

  • 5% annual interest from the date of the lawsuit until full payment

  • Dh1,000 in legal fees

  • All court fees and expenses

 

The ruling is now final and binding.
