
Husband Ordered to Pay Dh10,000 for Assaulting Wife After Conviction Upheld
Dubai Civil court awards damages with 5 per cent interest, citing proven physical and moral harm.
Dubai court has ordered a man to pay Dh10,000 in compensation to his wife after he assaulted her, following a criminal conviction that was upheld on appeal.
The case moved to the civil courts after the criminal proceedings concluded, with the competent court ruling that the husband must compensate his wife for the harm she suffered, along with interest at 5 per cent from the date the judgment became final.
The incident stemmed from a dispute between the couple that escalated from a verbal argument into threats and physical assault, leaving the wife injured.
She reported the matter to the police and submitted a certified forensic report confirming that she had sustained contusions and abrasions caused by impact and friction with hard objects. The report stated that the injuries required 20 days to heal and did not result in permanent disability.
A criminal case was subsequently filed against the husband, who was convicted and fined by the Court of First Instance. The judgment was later upheld by the Court of Appeal, making it final.
In its ruling, the civil court noted that the criminal judgment had been issued in the presence of the defendant and had become final after appeal. It added that the defendant failed to appear before the civil court despite being notified and did not present any evidence to challenge the claims.
The court found that the wife had suffered both physical and moral harm as a result of the assault and had also incurred expenses in pursuing her legal rights.
Concluding that all elements of tort liability were established, the court awarded Dh10,000 in compensation, along with legal interest at 5 per cent from the date the judgment became final until full payment. The defendant was also ordered to bear the legal costs and expenses.
