
Dubai Civil Court Dismisses Husband’s Dh176,000 Loan Claim Against Wife
Judge rules bank transfers alone cannot prove a debt between spouses without clear evidence showing the money was given as a loan.
The Dubai Civil Court has dismissed a lawsuit filed by a husband seeking to recover Dh176,000 from his wife, ruling that he failed to provide sufficient evidence to prove the amount was a loan.
The court also ordered the plaintiff to bear the legal fees, expenses and lawyer’s fees.
According to case records, the dispute arose after the husband claimed he had transferred various sums of money to his wife between May and September 2025, amounting to a total of Dh176,000. He argued that the transfers were loans repayable on demand and alleged that his wife later refused to return the money, prompting him to file a lawsuit.
To support his claim, the husband submitted documents including a copy of the marriage certificate and bank transfer statements showing the payments made during the specified period.
The wife contested the claim and requested the court to dismiss the case and order the plaintiff to pay the legal expenses.
After reviewing the documents and hearing oral arguments, the court reserved the matter for judgment before ultimately rejecting the lawsuit.
In its ruling, the court stated that bank transfers alone are not sufficient proof of a debt unless accompanied by clear evidence explaining the nature of the transaction, the reason behind it and the obligations arising from it.
The court further noted that the case file did not contain conclusive evidence proving the transferred amounts were loans, particularly as the marital relationship between the parties remains ongoing. It held that the husband’s claims were unsupported assertions lacking credible proof.
Accordingly, the court dismissed the lawsuit and ordered the plaintiff to pay the court fees and related expenses in line with the Civil Procedures Law.
