
Dubai Court Awards Man, 2 Daughters Dh1.1M in Fatal Medical Negligence Case
Failure to manage post-surgical complications and delayed intervention found to have led to patient’s death.
A Dubai court has ordered a doctor and a hospital to jointly pay Dh1.1 million in compensation to a husband and his two daughters after a patient died due to medical negligence following gastric sleeve surgery.
The Dubai Civil Court of First Instance held both defendants liable, finding that the woman succumbed to complications arising from a post-operative gastric leak that was not properly managed.
Court records show the patient was initially stable after the procedure but returned days later exhibiting symptoms of a leak. Although further treatment was undertaken, her condition worsened over several weeks.
A report by the Higher Committee for Medical Liability identified ongoing infection and inflammation caused by failure to control the leak, as well as delays in carrying out crucial diagnostic tests and implementing alternative treatment options. The patient was also not transferred to a specialised facility despite the seriousness of her condition.
The committee concluded that the standard of care fell short of accepted medical norms, directly resulting in severe complications, multiple organ failure and death.
The court awarded Dh100,000 to the husband for medical expenses and Dh1 million in moral damages to the family, along with 5 per cent interest from the date the judgment becomes final.
