India: Gujarat High Court Objects Against Anti-Conversion Laws

Gujarat High Court has objected to certain sections in the Freedom of Religion (Amendment) Act, 2021, stating that the same has the potential to be viewed as anti-interfaith marriage provisions exposing individuals who entered into valid interfaith marriages in serious risk of harassment. The legislation of similar laws and the propagation of the “Love Jihad” fear mongering about Muslims supposedly luring people of other faiths to marry them and convert to Islam had triggered much political altercations and dissent. This objection comes in the backdrop of the same. The High Court observed that the provisions might be misinterpreted as strictures against interfaith marriage. While the Respondents defended the law as only concerning individuals who enter into marriages by intimidation, the petitioners argued that the same is in violation of fundamental rights of equality, personal liberty and choice of faith, enshrined in the Indian Constitution.
