The UAE operates on a first-to-file system, not first-to-use. This means the first person to register a trademark owns it legally. If your trademark isn’t registered, someone else could legally take it from you.

But it goes deeper. In today’s market, counterfeiting, knock-offs, and brand imitation are more common than ever. If your trademark isn’t registered, you have no legal grounds to stop others from copying your products, your name, or your customer trust.

The UAE became a member of the Madrid Protocol in 2021, a major development for brand owners looking to expand globally.

Under the Madrid Protocol, once your trademark is registered in the UAE (or any member country), you can file one international application and seek protection in over 130 member countries, including:
United States, United Kingdom, European Union, Singapore, Malaysia, Indonesia, Turkey, and more.

  • Trademarks Registered Before Madrid Protocol:

Trademarks registered in the UAE before December 28, 2021, continue to be governed by the UAE's national trademark law. The Madrid Protocol does not retroactively apply to these marks. These registrations are national registrations and will continue to be governed by the UAE Trademark Law, not the Madrid System.

However, If the trademark owner now wishes to protect their mark internationally, they can use their UAE registration as a base application (or base registration) to file an international application through the Madrid Protocol.

  • Madrid Protocol in GCC:

The Madrid Protocol is not universally adopted within the Gulf Cooperation Council (GCC). Only the UAE, Bahrain, Qatar and Oman are members. This means that businesses seeking trademark protection in Saudi Arabia, Kuwait etc must still pursue national trademark registrations in those countries.
