Dh400,000 Awarded to Family of Indian Expat Cook Killed in UAE Road Accident

Court orders additional payout after insurance claim; family to receive total Dh400,000 compensation.

The family of an Indian expat cook who died in a road accident in Abu Dhabi last year has been awarded a total compensation of Dh400,000. The payout followed an additional claim filed after the initial diya (blood money) of Dh200,000 was granted.

 

The victim, 49-year-old Musthafa Odayappurath from Malappuram district in Kerala, died on July 6, 2023, after being hit by a car while crossing the road shortly after alighting from a bus. The accident occurred on Al Bateen–Al Khaleej Al Arabi Street. He suffered critical injuries and died at the scene.

 

Following the incident, the Abu Dhabi Criminal Court fined the driver Dh20,000 and ordered him to pay Dh200,000 in diya to the family. However, the family pursued an additional compensation claim, arguing that the amount was insufficient to secure the future of Musthafa’s dependents.

 

After examining supporting documents, including legal heir and breadwinner certificates, the court directed the insurance company to release an additional Dh200,000. This brought the total payout to Dh400,000 (around Rs9.55 million).

 

Musthafa, who worked as a cook for an Arab family in Abu Dhabi, is survived by his mother, wife, son, and daughter. His wife, Hajara, received the news of the compensation shortly before their daughter’s wedding, scheduled for September 11. She said the payout came as a much-needed relief for the family, even though it could never replace the loss of her husband.

 

Family members recalled that Musthafa used to visit home only once every 18 to 24 months and had a habit of sending gifts for children through cargo. On the day of his death, he was carrying a new outfit he had bought for his daughter.

 

At the time of the accident, both his children were minors. His daughter is now pursuing her degree and preparing for marriage, while his son is in Grade 12. The compensation is seen as a support for their education and future.

 

Under the Federal Traffic Law, failing to give priority to pedestrians at designated crossings carries a Dh500 fine and six black points. Penalties increase significantly in cases where accidents cause injury or death. Investigations, including Falcon Eye camera footage, confirmed that the accident was the result of negligent driving.
