
How Parents Can Obtain Birth Documents for a Child Born from an Unregistered Marriage Under the UAE Law
Court order is required to establish marriage and legal lineage before a child's documents can be issued.
Parents whose marriage was conducted without being officially registered may still be able to obtain identification documents for their child, but they must first secure a court ruling establishing both the marriage and the child's legal lineage under the UAE's Personal Status Law.
In cases where a Muslim couple entered into a marriage without a formal marriage contract, despite the presence of the bride's guardian and witnesses at the time of the ceremony, the absence of official registration can create legal obstacles when applying for a child's birth and identity documents.
Under the UAE's legal framework, the parents must file a case before the Personal Status Court in the emirate where they reside, seeking judicial confirmation of both the marriage and the child's lineage. During the proceedings, the court will require evidence that the marriage fulfilled the legal requirements under Islamic law. This includes summoning the wife's father, acting as her guardian, along with the witnesses who attended the marriage ceremony, to testify before the judge.
The court will also examine the child's parentage before issuing its decision. As part of the process, the judge may refer the father, mother and child to a forensic laboratory for DNA testing to establish the biological relationship between them. In addition, the child may be referred for a forensic medical examination to determine the child's age and date of birth where necessary.
Once the forensic reports and witness testimonies confirm that the marriage was valid and that the couple are the child's biological parents, the court may issue a judgment recognising the marriage and legally establishing the child's lineage.
After obtaining the judgment, the parents must open an execution file before the same court. This enables the relevant authorities to implement the court's decision and complete the procedures required to issue the child's official identification documents.
The legal process ensures that children born from unregistered marriages are able to obtain official documentation while safeguarding their legal identity and family rights in accordance with the UAE's Personal Status Law.
