Strengthening Patent Protection in the UAE: Understanding the Scope, Impact and Significance of the Executive Regulation

The United Arab Emirates has taken a significant step towards enhancing its intellectual property (IP) framework with the introduction of the Executive Regulation of Federal Law No. (11) of 2021 on Industrial Property Rights. • Undisclosed information, strengthening protection for trade secrets and proprietary know-how; and
• Mechanisms to convert applications between patents and utility certificates, offering flexibility based on the scope and nature of the invention.

These enhancements reflect international trends and provide more robust protection for a wide range of technological innovations.

By clarifying requirements relating to documentation, priority claims and corrections, the Executive Regulation significantly reduces procedural uncertainty. It also introduces provisions for urgent requests and the division of applications into multiple filings, offering applicants strategic options to tailor protection to their commercial needs.

Importantly, the regulation provides flexibility and concessions for start-ups, SMEs, academic institutions and research and development centres, underscoring the UAE’s commitment to fostering innovation across all economic segments.
