Withdrawing a job offer after an employee resigns can leave workers in a difficult position, but UAE regulations clarify how such cases are treated.

Accepting a new job offer often prompts employees to resign from their current roles in anticipation of starting a new chapter in their careers. However, complications can arise when a prospective employer withdraws the offer after it has already been accepted, leaving the employee without employment. UAE labour regulations provide guidance on how such situations are treated legally and what options may be available to affected employees.

 

Under the UAE’s employment framework governing private-sector workers, recruitment generally begins with the issuance of a job offer. Employers are required to provide a formal offer letter that outlines key terms and conditions of employment such as salary, job title, benefits and other essential details. This document serves as the initial agreement between the employer and the prospective employee.

 

While an offer letter reflects the understanding between the two parties, it is not always equivalent to a legally enforceable employment contract. In legal terms, an offer letter may be considered an agreement, whereas the employment contract — executed later in the recruitment process — constitutes the formal contract recognised under labour law. In principle, all contracts are agreements, but not every agreement automatically becomes a contract enforceable by law.

 

UAE regulations also require consistency between the job offer and the eventual employment contract. When an employer applies for a work permit for a new employee, the terms stated in the employment contract must correspond with those contained in the job offer. Additional terms may be included only if they provide benefits to the employee and do not contradict the provisions of the law or its implementing regulations.

 

To standardise this process, employers must use approved electronic forms for work permits, offer letters and employment contracts through the Ministry of Human Resources and Emiratisation (MoHRE) system. These forms ensure transparency and uniformity in recruitment procedures across the private sector.

 

During the hiring process, the employer submits the signed offer letter along with other required documentation when applying for a work permit for the prospective employee. Once the permit is processed and the relevant fees are paid, the employment contract is executed between the employer and the employee in accordance with the approved format.

 

Problems may arise when an employer withdraws the job offer before the employment contract is finalised, particularly if the employee has already resigned from a previous job relying on that offer. In such circumstances, the withdrawal of the offer may cause financial loss or other damages to the employee.

 

Although an offer letter may not always carry the same legal weight as a formal employment contract, employees who suffer losses due to the withdrawal of a job offer may still seek remedies through the courts. Affected individuals may consider filing a civil case against the prospective employer in a competent UAE court, claiming compensation for financial losses or damages resulting from the withdrawal of the offer.

 

Courts typically examine the circumstances of the case, including whether the employee relied on the offer in good faith, the nature of the agreement between the parties and the extent of any damages suffered. Evidence such as the signed offer letter, communication between the parties and proof of losses may play a crucial role in determining the outcome.

 

Employees facing such situations are also advised to seek guidance from MOHRE or obtain independent legal advice to better understand their options and the appropriate legal steps.

 

Ultimately, while UAE labour regulations require transparency and consistency in the hiring process, disputes may still arise when job offers are withdrawn. In these cases, the legal system provides mechanisms through which affected employees may pursue compensation for the losses they incur.
