Passport Forgery Lands Man in UAE Jail, Court Orders Deportation

Authorities confiscated the falsified passport and residency permit after the court upheld the jail term and deportation order.

The Federal Supreme Court has upheld a ruling sentencing a man to six months in prison, followed by deportation, for forging a passport and residency permit. The court also ordered the confiscation of all forged documents seized in the case.

Prosecutors said the defendant worked with an unidentified accomplice to falsify an official passport using his personal details and photograph. The forged passport was later used to obtain a 90-day residency visa, in violation of UAE immigration laws. He was also charged with providing false information to officials and entering the country illegally.

The Court of Appeal’s State Security Chamber had previously sentenced him to six months in jail, ordered deportation after completion of the sentence, and ruled that the forged documents be confiscated, along with court costs.

The Public Prosecution appealed, arguing that the offence warranted a harsher penalty. The Federal Supreme Court rejected the appeal, noting that under Article 32 of Federal Decree-Law No. 29 of 2021 on the Entry and Residence of Foreigners, suspended sentences and pardons do not apply to such offences. The court confirmed the lower court’s ruling, taking mitigating circumstances into account under Article 99 of the Penal Code.
