
Al Ain Court Orders Parent to Pay Dh20,000 Compensation in Injury Case
Parent held liable after minor’s negligence at school bathroom leads to fingertip amputation and permanent injury to classmate.
The Al Ain Civil, Commercial and Administrative Cases Court has ordered a parent to pay Dh20,000 to the mother of a minor student who suffered injuries in a school incident involving the parent’s son.
The two children, who were classmates, were involved in an incident in the school bathroom. The defendant’s son kicked the bathroom door without checking if anyone was inside, causing it to slam shut on the victim’s finger. The impact led to the amputation of the tip of the little finger on the child’s left hand.
The injured child’s mother filed a lawsuit seeking Dh300,000 in comprehensive compensation, citing physical harm, psychological trauma and future damages, including permanent disability. She also sought reimbursement of legal costs and expenses.
According to the claim, the injury occurred when the other child forcefully shut the bathroom door, causing severe harm. The plaintiff noted that the boy responsible had already been convicted in a criminal case, with the court finding that the injury resulted from negligence in failing to take necessary precautions before kicking the door.
The court, relying on case documents and an accredited medical report, confirmed that the victim sustained an amputation of the fingertip, along with nail dislocation and a fracture at the upper end of the affected area. While the injury resulted in a permanent disability at the site, it did not completely impair the finger’s function.
Taking these factors into account, the court awarded Dh20,000 in compensation to cover the material and psychological damages suffered by the child.
