Abu Dhabi Civil Court Orders Man to Repay Dh4,309 in Mobile Recharge Fraud

Defendant deceived victim into transferring funds; earlier fined Dh15,000 in related criminal case for online scam.

The Abu Dhabi Family, Civil and Administrative Cases Court has ordered a man to repay Dh4,309 to another individual after defrauding him through an online mobile recharge scam. The court also directed the defendant to bear all legal fees and court expenses.

 

According to court documents, the plaintiff had transferred Dh4,309.81 to the defendant, believing that the money would be used to recharge his mobile balance. It was later discovered that the transaction was fraudulent, leading the victim to file a criminal complaint.

 

A criminal court had earlier found the defendant guilty of fraud and imposed a Dh15,000 fine.

 

In the subsequent civil case, the Abu Dhabi court ruled that the final criminal judgment constituted conclusive evidence of guilt. The court observed that the fraud was fully established and could not be re-examined in civil proceedings.

 

As the defendant failed to prove that he had repaid the amount or settled his obligation, the court ordered him to refund the full sum to the plaintiff and cover all associated costs.
