
Abu Dhabi Court Directs Man to Return Dh58,000 Illegally Seized from Woman
The defendant, found guilty of possessing illicit funds, was also directed to compensate the victim and cover legal costs.
The Abu Dhabi Family, Civil and Administrative Cases Court has ordered a man to return Dh58,868 to a woman after finding him guilty of fraudulently obtaining the amount. The court also directed him to pay Dh5,000 in compensation, along with court fees and legal expenses.
The case began when the woman filed a lawsuit accusing the man of fraudulently seizing her money. She demanded the return of Dh58,868 and sought Dh30,000 in compensation for the harm she suffered, in addition to legal costs.
Investigations revealed that the man had received financial deposits from the woman’s account into his own without any legitimate or contractual relationship between them. Despite knowing the money’s dubious origin, he accepted the deposits without informing the authorities.
The Bani Yas General Prosecution had earlier convicted him of possessing funds obtained through a fraudulent act and sentenced him to imprisonment. On appeal, the Criminal Court modified the verdict, ordering his deportation and obliging him to pay the associated fees. The judgment became final after no cassation appeal was filed.
Relying on the criminal court’s findings, the civil court concluded that the defendant had indeed obtained the woman’s money unlawfully. It therefore ordered him to repay the full amount of Dh58,868.
The court further held that the woman had endured both material and moral harm as a result of being deprived of her money. Consequently, the man was ordered to pay Dh5,000 in compensation, in addition to covering all court fees, expenses, and the plaintiff’s legal costs.
