Abu Dhabi Court Orders Medical Centre to Pay Doctor Dh318,690 in Labour Dispute

Court of Cassation upholds ruling; doctor to receive Dh168,690 after offsetting notice allowance owed to employer.

The Abu Dhabi Court of Cassation has upheld a Court of Appeal ruling in a labour dispute between a doctor and a medical centre, finalising the financial settlement in favour of the employee.

According to case records, the doctor filed a claim (Labour Case No. 113/2025) before the Abu Dhabi Court seeking unpaid wages, vacation pay, gratuity, and other employment benefits. She stated that she had joined the centre under a fixed-term contract on October 24, 2022, with a total monthly salary of Dh150,000, including a basic salary of Dh75,000 and a 20 per cent commission. She resigned on December 26, 2024, and worked until February 25, 2025, citing the employer’s breach of contract.

The doctor demanded Dh30,000 in delayed wages, Dh72,500 as vacation allowance, Dh95,000 as end-of-service gratuity, and other benefits such as the cancellation of her medical licence and an experience certificate.

 

In response, the medical centre filed a counterclaim (Case No. 147/2025), demanding Dh150,000 as notice allowance and Dh300,000 for alleged damages caused by professional errors. The two cases were later combined as they involved the same parties and subject matter.

 

On April 28, 2025, the Court of First Instance ruled in favour of the doctor, ordering the centre to pay Dh392,708 in total, including delayed wages, vacation allowance, notice allowance, and gratuity. It also directed the centre to issue an experience certificate. However, the court ordered the doctor to pay Dh150,000 to the employer as notice allowance for not completing the notice period.

 

Both parties appealed the ruling. The Court of Appeal reviewed the case with the help of a panel of experts and, after examining financial records and submissions, amended the earlier decision. On August 27, 2025, it ordered the medical centre to pay the doctor Dh318,690 while maintaining the Dh150,000 notice allowance payable to the employer.

 

The doctor challenged this decision before the Court of Cassation, claiming errors in the expert’s calculations and arguing she was entitled to higher dues. However, the court found no error in the appellate ruling and confirmed that it had correctly applied the law and properly assessed the evidence.

 

The Court of Cassation dismissed the appeal, ordering the doctor to pay the court fees and Dh500 in legal costs to the employer, while also confiscating the appeal deposit.

 

With this decision, the ruling of the Court of Appeal has become final. The medical centre must pay the doctor Dh318,690, while she must pay the employer Dh150,000 as notice allowance. After offsetting these amounts, the doctor will receive a net payment of Dh168,690.
