Abu Dhabi Court Orders Seller to Repay Dh670,000 for Concealing Defective Vehicle

Buyer wins compensation after discovering luxury car had been in four accidents despite seller’s ‘like-new’ claim.

The Abu Dhabi Family, Civil and Administrative Cases Court has ordered an individual to refund Dh670,000 to a buyer after fraudulently selling a vehicle with hidden defects. The court also imposed a Dh50,000 fine on the seller.

 

According to case records, the seller had advertised the vehicle on social media, describing it as “like new” and free of any prior accidents. However, after the sale, the buyer discovered through online sources that the vehicle had been involved in four accidents that were never disclosed.

 

The buyer subsequently filed a lawsuit seeking to cancel the sale agreement, recover the full purchase amount of Dh670,000, and obtain compensation for material and moral damages amounting to Dh100,000. He also requested that the seller take back the vehicle and transfer its ownership back to his name once the refund was completed.

 

A technical expert appointed by the court examined the vehicle and confirmed the existence of several major mechanical, electronic, and structural faults. These included defects in the accelerator pedal, oil pressure system, rear collision radar, airbags, and electronic stability control system. The expert concluded that these hidden defects posed safety risks and rendered the vehicle unfit for use.

 

Based on the evidence and expert findings, the court ruled that the seller had deliberately concealed the defects, constituting fraud and deception. It ordered the cancellation of the sales contract, a full refund of the sale amount, and the transfer of ownership back to the seller.

 

The court also ruled that Dh50,000 would be adequate compensation for the buyer’s material and moral damages.
