Abu Dhabi Court Orders Woman to Pay Dh10,000 for Verbal Insult

Civil court relies on earlier criminal conviction to award compensation for moral and psychological harm caused by abusive and defamatory remarks.

An Abu Dhabi court has ordered a woman to pay Dh10,000 in compensation for verbally insulting another woman, ruling that the abuse caused moral and psychological harm.

 

The judgment was issued by the Abu Dhabi Family, Civil and Administrative Claims Court, which found that the defendant’s conduct undermined the claimant’s dignity and resulted in emotional distress.

 

According to court records, the claimant had filed a civil lawsuit seeking Dh25,000 in damages, in addition to legal fees, after being subjected to insulting and defamatory remarks. The defendant had earlier been convicted in a criminal case for verbal abuse and fined Dh3,000.

 

In support of her civil claim, the claimant submitted copies of the criminal judgments along with a certificate confirming that the rulings were final and no longer open to appeal. The defendant, however, sought dismissal of the civil case.

 

The court ruled that the prior criminal conviction conclusively established the occurrence of the abuse and the defendant’s responsibility, leaving no scope to dispute the facts in the civil proceedings.

 

Referring to the Civil Transactions Law, the court noted that any person who causes harm to another is legally obliged to provide compensation. It concluded that the defendant’s actions had exposed the claimant to contempt and psychological suffering, and accordingly ordered the payment of Dh10,000 in damages, along with all court costs and legal fees.
