
Abu Dhabi Family Court Orders Man to Repay Dh100,000 Loan to Woman
The defendant admitted receiving the money but failed to prove repayment was not due.

The Abu Dhabi Family, Civil and Administrative Claims Court has ordered a man to return Dh100,000 to a woman after finding he failed to provide evidence absolving him of the debt.
Case records show the woman filed a lawsuit seeking repayment of the amount, along with 12 per cent legal interest, court fees, and immediate execution of the judgment without a guarantee. She stated that she had transferred the money to the man as a loan, based on trust and personal acquaintance, to help him with financial difficulties. Despite repeated requests, he refused to repay. To support her case, she submitted WhatsApp conversations, a bank transfer receipt, and a certificate in his name.
The man acknowledged receiving the money but argued repayment was not yet due, claiming the loan was tied to the completion of construction or availability of funds. He asked for the case to be dismissed as premature or, alternatively, for repayment to be allowed in installments or reviewed by an expert.
The court, however, ruled that the messages showed his clear acknowledgment of the loan and intention to repay, undermining his defense. It also rejected his request for an oath, calling it abusive, since he offered no proof to discharge his liability.
Accordingly, the court ordered him to repay the Dh100,000 with 3 per cent annual interest from the date the case was filed until full settlement, capped at the principal amount. All other claims were dismissed.
