
UAE Court Awards Woman Dh20,000 After Man Illegally Entered Her Home
Al Ain court says the trespass caused significant psychological harm and violated the woman's right to privacy.
An Al Ain court has ordered a man to pay Dh20,000 in compensation to a woman after unlawfully entering her home, ruling that the incident caused her significant psychological distress and violated her privacy.
The Al Ain Court of First Instance issued the compensation order after the defendant had already been convicted in criminal proceedings of trespassing on the woman's private residence in circumstances prohibited under UAE law.
According to court records, the woman filed a civil claim seeking damages following the final criminal conviction. During the civil proceedings, she submitted a legal certificate confirming that the criminal judgment had become final after no appeal was lodged, making the conviction binding on the civil court.
In her claim, the woman said the man's unauthorised entry into her home left her traumatised, frightened and suffering from prolonged anxiety. She argued that the incident shattered her sense of safety and security within her own residence.
Court documents also indicated that the trespassing was not an isolated incident but occurred against the backdrop of an ongoing dispute between the two parties.
In its judgment, the court noted that the defendant's criminal liability had already been conclusively established and, under UAE law, this prevented the civil court from reconsidering the facts surrounding the offence. The court therefore focused on determining the extent of the harm suffered by the plaintiff and the appropriate compensation.
The court found that the defendant's actions had caused the woman clear moral and psychological harm, emphasising that UAE law requires anyone who causes damage to another person to compensate the victim.
Accordingly, the court ordered the defendant to pay Dh20,000 in compensation for the emotional distress and infringement of the woman's privacy, in addition to bearing the legal costs and court fees associated with the case.
