
Al Ain Court Dismisses Company's Dh100,000 Lawsuit Against Ex-employee
The Al Ain Court for Civil, Commercial, and Administrative Claims rules lack of evidence in alleged breach of non-compete clause.
Al Ain: The Al Ain Court for Civil, Commercial, and Administrative Claims has dismissed a company’s lawsuit seeking Dh100,000 in compensation from a former employee, ruling that there was insufficient evidence to prove he had violated a non-compete agreement.
The company had also requested that the employee’s work permit be suspended, claiming he had breached the non-compete clause and caused it financial losses. However, the court found no credible proof supporting these allegations.
In its judgment, the court noted that the firm failed to present documents or evidence substantiating the alleged breach. Consequently, it resolved the dispute by directing a decisive oath to the defendant -- a procedure allowed under UAE civil law when documentary evidence is lacking.
Court records indicate that the employee, who joined the company in 2018 with a total monthly salary of Dh7,500 including a Dh2,800 basic salary, was accused of working for a competitor. The court concluded that the company’s claims were unsubstantiated and dismissed the case in the employee’s favour.
