Court Rejects Dh34,199 Phone Bill Lawsuit After Plaintiff Fails to Prove SIM Card Misuse

Al Ain court finds no evidence linking defendant to disputed charges; says allegations of deceit fall under criminal, not civil, law.

The Al Ain Court for Civil, Commercial and Administrative Claims has dismissed a lawsuit filed by a man seeking to recover Dh34,199 in mobile phone charges, ruling that he failed to prove the defendant’s involvement in the disputed SIM card transactions.

 

According to Emarat Al Youm, the plaintiff alleged that the defendant had exploited his circumstances by obtaining a SIM card using his digital ID and using it for personal benefit. He demanded repayment of the entire amount, along with legal interest, court fees, and attorney’s fees, and requested that a technical expert be appointed to verify the call records.

 

The plaintiff further claimed that the defendant had misrepresented himself as a government employee who could assist in securing financial aid and a loan to build a home extension for his son, who is of determination.

 

The defendant, in response, denied the accusations, submitted screenshots of their phone conversations, and sought dismissal of the case.

 

In its judgment, the court found that the plaintiff failed to establish any conclusive link between the defendant and the phone charges or to prove his lack of knowledge about the SIM’s use. It also noted that the plaintiff’s claims, which implied deceit, were of a criminal nature and therefore outside the scope of civil proceedings.

 

As a result, the court dismissed the lawsuit and ordered the plaintiff to bear all legal costs.
