Delhi High Court Bars Indian Kitchenware Firm from Using Barbie Trademark

Interim order prevents Padum Borah from exploiting Mattel’s globally recognised brand, including social media accounts and domain names.

The Delhi High Court has restrained an Indian businessman from using the Barbie name or any similar trademark in his business activities, following a suit filed by Mattel for trademark infringement.

 

In an interim order, Justice Manmeet Pritam Singh Arora noted that the defendant, Padum Borah, had used marks such as Barbie Enterprises, Barbie Kitchen, and Barbie Catering to generate initial interest in his products. The judge observed that continued use would cause irreparable harm to Mattel Inc, the owners of the Barbie brand.

 

“In the considered opinion of this Court, the Plaintiff has been able to make out a prima facie case in its favour. The balance of convenience is also in favour of the Plaintiff and against the Defendant. The Plaintiff is likely to suffer grave irreparable harm in case an ad-interim injunction is not granted,” the court said.

 

The order directs Borah to cease using the Barbie trademark and remove all social media posts and accounts referencing the brand. The court also ordered the suspension of domain names containing the Barbie name.

 

Mattel had informed the High Court that it owns the globally recognised BARBIE trademark, which has been registered in multiple classes in India since 1985 and extensively used in the country since 1987.

 

In August 2024, Mattel discovered that Borah had applied for and was using a series of marks including ‘BARBIE One Stop Solution for HORECA Foods’, ‘BARBIE ENTERPRISES’, and ‘BARBIE HOSPITALITY’ for commercial kitchen equipment and catering services.

 

Despite a cease-and-desist notice, the defendants did not respond, and the Trademarks Registry flagged conflicts between Borah’s applications and Mattel’s prior registrations.

 

After hearing the case, the court confirmed that Mattel is the registered proprietor of the Barbie trademark and granted the injunction.
