Dubai court orders buyer to pay Dh1.54M under deposit clause after failing to complete a property deal, ruling in favour of the seller.
Dubai court has ruled in favour of a property owner, ordering a buyer to pay Dh1.54 million under a deposit-retention clause after she withdrew from completing a real estate transaction.
The Dubai Court of First Instance (Real Estate Division) confirmed the termination of the sale agreement and directed the buyer to cover the amount, in addition to court fees, legal expenses, and lawyers’ fees.
The dispute involved a residential unit in Al Wasl. The seller had agreed to transfer ownership in exchange for a Dh2.2 million deposit, with the remainder due upon completion.
Although the buyer issued a cheque signalling her commitment, she missed the agreed deadline and requested an extension, citing delays with her Emirates ID and administrative approvals —conditions not part of the original agreement.
The court highlighted that the seller acted in good faith, granting additional time to finalise the transaction. Despite this, the buyer failed to complete the procedures, settle the balance, or provide evidence of circumstances beyond her control preventing performance of her contractual obligations.
