Dubai Court Orders Luxury Transport Firm to Refund Dh40,000 After Repossessing Lexus, Grants 5% Interest and Costs

Company failed to justify retaining client’s payment despite recovering vehicle; court rules in favour of buyer.

The Dubai Civil Court has ordered a company operating in luxury car passenger transport to pay Dh40,000 to a client, along with legal interest of 5 per cent from the date of filing the claim until full settlement, in addition to court fees, expenses and legal costs.

The case arose after a man filed a lawsuit seeking the recovery of Dh40,000 he had paid to the company under an agreement to purchase a 2023 Lexus vehicle. The amount included Dhs35,000 as a down payment and Dh5,000 towards two instalments, supported by stamped invoices and receipts issued by the company.

According to court documents, the company later repossessed the vehicle. When the client requested a refund of the amounts paid, the company refused without any legal basis, prompting him to initiate legal proceedings.

The claimant submitted copies of receipts and invoices as evidence of payment. During the proceedings, he appeared before the Case Management Office and sought referral of the matter to the court, while the defendant company failed to attend any hearings, including the final session.

The court found that the plaintiff had provided sufficient documentary proof establishing the company’s liability, while the defendant failed to present any defence or evidence of repayment. Accordingly, the court ruled in favour of the claimant, ordering the company to refund the full amount, along with 5 per cent annual interest from the date of the claim until payment, in addition to litigation costs.
