Dubai Courts Uphold Dh1M Award to Expat with Spinal Injuries, Rejecting all Appeals Despite Shared Liability

Higher courts dismiss appeals, confirming Dh1m compensation for Indian pedestrian injured in Dubai crash despite partial fault.

An Indian woman who sustained severe injuries in a road accident has been awarded Dh1 million in compensation.

 

The incident occurred in April 2023 near the Bangladesh Consulate in Dubai’s Al Wahida area. Rehmathbi Mamad Sali was hit by a Nissan Patrol while crossing the road at a spot not designated for pedestrians. She suffered multiple serious injuries, including a spinal fracture, brain haemorrhage, and partial paralysis in her right arm and leg.

 

Investigations found that the UAE national driver had been negligent and failed to take proper precautions for other road users. The court also held Rehmathbi partially responsible for crossing without paying adequate attention to oncoming vehicles.

 

Following the accident, she was hospitalised at Rashid Hospital. In the related criminal case, the driver was fined Dh3,000, and Rehmathbi was fined Dh1,000.

 

A civil lawsuit was later filed seeking compensation, supported by medical records and court documents. The court acknowledged the extent of her injuries and ordered the insurance company responsible at the time of the accident to pay Dh1 million. Appeals filed by the defendants were dismissed by higher courts, and the compensation award was upheld.
