High Court Dismisses Plea Against Jolly LLB 3, Finds Nothing Objectionable

Court finds no content in trailers or songs that undermines legal profession, dismisses plea seeking ban.

A petition seeking to ban the release of Akshay Kumar-starrer Jolly LLB 3, claiming it demeaned the legal profession, has been rejected by the Allahabad High Court.

 

The plea argued that the film’s trailers and songs portrayed lawyers in a derogatory manner, potentially lowering the dignity of the judiciary in the eyes of the public. It claimed that such portrayals could discourage aspiring law students and prejudice practicing advocates, thereby impacting the justice delivery system.

 

The Division Bench of Justices Sangeeta Chandra and Brij Raj Singh reviewed all three official trailers and teasers, as well as the lyrics of the song Bhai Vakeel Hai (Brother is a Lawyer). The Court found no content warranting judicial intervention.

 

“We have also gone through the lyrics of the song and do not find anything that may interfere with the practice of law by genuine advocates,” the Court noted in its September 2 ruling.

 

The petitioner, Jay Vardhan Shukla, contended that the widespread circulation of the trailers and songs on YouTube and other social media platforms had already caused prejudice against practicing advocates and injured the reputation of the judiciary.

 

However, Deputy Solicitor General S.B. Pandey challenged the maintainability of the plea, noting that the petitioner had not approached the appropriate authority before filing the petition. For complaints regarding online content, the petitioner should first seek redress under the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

 

The Court found merit in the Union of India’s objection and dismissed the petition, stating:

 

“We find from the petition that the petitioners have not yet approached any authority as prescribed under the 2021 Rules. The preliminary objection raised by the learned Deputy Solicitor General of India carries substance.”
