Court Orders Dh100,000 Compensation for Indecent Acts Against Child

Abu Dhabi Family court Judge rules defendant must pay moral damages for abuse and gestures towards minor.

The Abu Dhabi Family, Civil, and Administrative Cases Court ordered a man to pay Dh100,000 in compensation after verbally abusing, physically assaulting, and making indecent gestures toward a child.

 

In detail, the child’s father filed a lawsuit against the defendant, demanding Dh100,000 as reparation for the harm caused to his son, along with the defendant covering the legal fees and expenses. The plaintiff stated the defendant verbally abused, physically assaulted, and caused injuries to his minor son, in addition to making indecent gestures.

 

He added that the defendant was earlier sentenced to one month of suspended imprisonment and fined Dh10,000, with the ruling becoming final as no appeal was filed.

 

The court clarified that Article 282 of the Civil Transactions Law obligates anyone who inflicts harm on another to compensate the victim. The compensation amount is decided by the judge after considering the case’s circumstances.

 

The court also highlighted that the victim was a minor child lacking the maturity to process or cope with such insults, stressing that verbal abuse deeply impacts a child’s psyche, reputation among peers, dignity, and confidence, thereby affecting their personality.

 

Given that the criminal ruling established the defendant’s guilt, the court awarded the plaintiff, as the child’s guardian, Dh100,000 in moral compensation.
